Britney Spears - The road to freedom

Britney Spears' team has taken the first step toward ending the conservatorship, TMZ has learned ... but it's by no means a done deal.

Sources tells us lawyers and others connected with the case have been meeting ... evaluating Britney's progress with the goal of ending the conservatorship. As we first reported, Britney's dad, Jamie Spears, wanted to wait until her tour ended before making the big move, but it's something he wants for his daughter only when the time is right.

We know there have been several lengthy meetings recently between the lawyers and the court commissioner in the commissioner's chambers.

Jamie and the lawyers will not make the decision to end the conservatorship. They will weigh in, but the person with all the influence is the "capacity expert" -- a psychiatrist who was appointed by the court. The capacity expert will do a thorough evaluation and submit it to the commissioner.

We're told one of the fears Jamie has ... Sam Lutfi, a guy Jamie thinks is still a threat to Britney if she allows him back in her life. He's got that right.

There are actually two conservatorships -- one over Britney, the person, and the other over Britney's business affairs. We're told the business conservatorship will likely continue.

The issue on the table is whether to end the conservatorship over Britney, the person. Again, no decisions have been made, but it's all moving in that direction.

Britney receives new BMW for her Birthday

Sounds like Britney Spears had herself a very happy birthday indeed!

The singer, who turned 28 yesterday, received a shiny new white BMW convertible with a ribbon on it and balloons inside during a party at her Calabasas home.

Birthday girl Brit was in good spirits, a source tell E! News. She was dressed sexily, in a blue velvet blazer, shorts and fishnet stockings.

She had a cake presented to her around 10 p.m., but there was no champagne toast, since no alcohol was served at the soiree, the insider tells us.

"It was really mellow," says the source.

So who was on hand to help her celebrate? Boyfriend, Jason Trawick (who went shopping with her earlier), dad Jamie, her two boys, manager Larry Rudolph, as well as some backup dancers and friends.

If you didn't get an invite, don't feel bad. Less than 20 people attended. No word on where her mom and sister were.

Britney does ELLE

The pop superstar still owns the charts and continues to captivate us.

A decade after her titillating debut in pigtails and a plaid Catholic school skirt, we find ourselves cheering on Britney Spears once again. There have been, of course, speed bumps in recent years - a divorce, feuds with family, a very public breakdown - but the past 12 months have witnessed a cautious yet emphatic comeback. With Circus, her triumphant 2008 album and subsequent world tour, Britney reasserted herself as a pop music ringleader, firmly in control of the spectacle. The album is the star’s fifth to debut at No. 1 on the Billboard 200 - making her the youngest woman to accomplish that feat. And the nearly yearlong tour, with its elaborate $50 million extravaganza featuring DSquared2 costumes (nine outfit changes a night, including Britney as a trapeze artist, a magician’s assistant, and, somewhat perplexingly, a policewoman), was among the highest-grossing concert tours in the United States last year, rivaling those of U2 and Bruce Springsteen. With another greatest-hits record freshly arrived (and a new single, "3," which raced up the Billboard chart), we see flashes of vintage Brit, the one we love - blond, happy, and back on top.

This is no small turnabout. Rare is the artist who can pirouette from teen idolhood to a discerning adult audience; not even Madonna, Britney's idol, had to do that. But Britney was a teen pop princess who knew how to build an image (the virginal temptress) and sell it through videos (her 1999 breakout "...Baby One More Time") that nimbly walked the line between sweetness and provocation. Now, at 28, her sound is grittier (as in the throbby 2008 hit "Womanizer") and her lyrics reveal a confident sexuality. Britney may have sung "I'm not that innocent" on her 2000 single "Oops!... I Did It Again," but today, there's no argument, with frank lyrics such as those on "3": "Merrier the more/ Triple fun that way/ Twister on the floor."

Britney spends 28th Birthday with her men

Britney Spears celebrated her 28th birthday on Wednesday surrounded by the men in her life - boyfriend Jason Trawick and sons Preston and Jayden.

The singer and her agent beau Trawick, 37, started the celebration a day early Tuesday night at L.A.'s Mondrian hotel, where Spears also enjoyed spa services, a source tells PEOPLE.

That night, the couple went to the Sunset strip, visiting both the Saddleback Ranch restaurant and Chateau Marmont. The next day, they shopped at West Hollywood's Fred Segal boutique before reuniting with the pop star's sons Preston, 3, and Jayden, 2, at her home in Calabasas.

"Britney looked so happy," says an eyewitness. "She seemed very excited to spend her morning with Jason."

Spears was also thrilled to get to be with her two boys on her B-day, says another source. "Britney is very happy to spend the day with Preston and Jayden. The kids know it's her birthday ... [They] are very excited about Britney's cake too."

Happy Birhtday Britney!

One year ago, on this very day, I was in New York City for Britney's Birthday and the release of Circus. It was when the lights came down at the Big Apple Circus and that Britney's silhouette appeared on top of the cage before she would perform Circus... She was waving at us, stretching a little bit to warm up. That's when I knew everything would be ok. She was fine. Her family was there with us, in the audience, to support her. It's hard to describe this intense feeling but everyone who was present this day just knew.

What I'm trying to say is that during the last year, Britney turned her life around for the better and words can hardly describe how proud and happy we all are.

You deserve all the beautiful things happening to you. Thank you for being who you are. I hope you get to spend this special day with your loved ones and may the upcoming year in your life be as beautiful and amazing as you want it to be.

Happy Birthday Britney <3
